It is being recorded that Benonil AH Ext 1 is currently being subdivided. The Remaining Extent measuring 1.0540 Ha is being sold as per the Sketch Plan dated 2026/08/04, Ref. No. SD1267/26.
The application for subdivision is in its final stages of being compiled for lodgement. Once the application is submitted to Council, there will be a public participation period and internal departmental circulation period, which is anticipated to take approximately 3 months from the date of lodgement.
If and once all comments have been received in support of the application, Council will consider and approve the application, which, depending on Council's workload, could take approximately 1 month.
The approval will then allow the land surveyor to submit the SG diagrams to the Surveyor-General for approval, which is anticipated to take approximately 4 weeks. At this point, compliance with the approval conditions and payment of applicable bulk contributions will be required.
Following approval by the Surveyor-General, the attorneys will need to apply for the Section 125 Certificate, which could take approximately 3 to 6 months. Upon receipt of the Section 125 Certificate, and provided that all other required documentation has been obtained by the attorneys, the transfer can proceed.
The Seller will be responsible for all costs relating to the successful completion of the required approvals, documentation and processes to enable the registration and transfer of the property, including any amounts that become payable to Council in respect of bulk contributions.
